In these Terms and Conditions, the following words and expressions shall have the meaning set out below:
1.1 “Advertiser” means Ashwin Sheth Group, whose
apartment(s)/flat(s)/unit(s) of the projects are highlighted in the
advertising material.
1.2 “Advertising Material” means promotional material (including any
text, images, audio and video content) to be placed on one or more
Platforms in accordance with the terms of this Agreement.
1.3 “Agreement” means these Terms and Conditions and the associated
booking terms laid down in booking form and/or Agreement for sale.
1.4 “Agreement for sale” shall have meaning as defined under section
2(c) of the Real Estate (Regulation and Development) Act, 2016.
1.5 “Allottee” shall have meaning as defined under section 2(d) of the
Real Estate (Regulation and Development) Act, 2016.
1.6 “Ashwin Sheth Group or ASG” shall mean and include all
companies, partnership, Limited Liability partnership which are
operating under the umbrella of ASG.
1.7 “Assured Prize” shall mean any prize, as provide under clause 3,
won by the allottee by the way of spin the wheel during the camping
period.
1.8 “Booking Terms” means terms as defined under the Booking form.
1.9 “Campaign Period” means the period commencing from 18.04.2024
till 20.05.2024, unless extended by the ASG, during which the
Advertising Material will be placed on one or more Platforms.
1.10 “Project” shall mean and include Sheth Avalon – Phase 2, Avante,
Montana, Sheth Zuri, Sheth Vasant Lawns and Edmont – Aurelia, all
of which are registered with MahaRERA and developed by the ASG.
Participation in the Spin the Wheel competition is open to any new allottee that books an apartment/flat/unit, as applicable, during the camping period for the project(s) (defined hereinabove) is being developed by ASG.
The assured prizes to be won during the validity of the camping period are as under:

4.1 The allottee will only be allowed to spin the wheel once when booking an apartment, flat, or unit, as applicable. This will be closely and personally supervised by the project's Site Head and Closing RM.
4.2 If, during the wheel's spin, the pointer stops precisely in the middle of the two quadrants, the winner will be entitled to select any one prize that is listed in the two quadrants where the pointer stopped.
4.3 Any allottee discovered to be in violation of the rules, to have spun the wheel in an unethical manner, or to have interfered with its spinning will be disqualified from the contest and all guaranteed prizes shall be forfeited. The offending allottee shall also be liable for strict action as determined by ASG.
4.4 If the allottee does not wish to accept the assured prize won during the contest, the allottee shall have an option to take credit note of the equivalent amount as specified in the clause 3.
4.5 It is hereby clarified that bike price as indicate in the clause 3 are ex-showroom price and all other formalities such as on-road tax, registration, etc. shall be borne by such the allottee.
4.6 The allottee shall be entitled to receive assured prize won by them within 25-30 days from the date of paying 18% as per payment Schedule annexed to the agreement for sale of the apartment/flat/unit, as the case maybe.
4.7 It is hereby clarified that if any allottee, files any litigation including arbitration against ASG or claims any compensation/interest from ASG for any reason whatsoever, the assured prize won by them or credit note raised under these offer, shall stand forfeited.
4.8 The credit note raised in favour of the allottee under this offer shall take effect only during last two pending installment of the payment schedule annexed to Agreement for sale of the apartment/ flat/unit, as the case maybe.
4.9 It is hereby clarified that if any allottee opts to cancel the purchase of apartment/flat/unit, as the case maybe, at any time before the possession is offered by ASG, the credit note or any prize/benefits received under this offer shall stand forfeited and ASG shall be entitled to adjust the equivalent amount as specified under clause 3 against the refund payable to such an allottee.
The Allottee agrees to defend, indemnify and hold harmless ASG and its officers, directors, agents, affiliates and employees, at all times against all claims, proceedings, demands, damages, liabilities and costs (including reasonable legal fees) arising in connection with the breach of this Agreement by the Allottee.
It is hereby clarified that BMW is the registered trademark of BMW AG, Harley Davidson is the registered trademark of H-D U.S.A., LLC. and iPhone is the registered trademark of Apple Inc.
Any dispute arising out of this Agreement shall be in the first instance settled by amicable negotiation between the parties hereto. Any or all disputes or differences whatsoever that are not settled amicable within Thirty (30) days between the ASG and the allottee in relation to the interpretation, meaning or effect of this Agreement, or to any breach thereof the parties shall refer the dispute(s) to arbitration of sole arbitrator in accordance with the provisions of the Arbitration and Conciliation Act, 1996, for the time being in force. Both Parties shall mutually appoint a sole arbitrator to resolve the dispute(s). The arbitration proceedings shall be conducted in English. The proceedings shall be governed by the laws of India and the seat and venue for the arbitration proceedings shall be Mumbai. This Agreement is made under and will be construed in accordance with the law in the jurisdiction of the courts at Mumbai.
The allottee shall not be entitled to assign any benefits received by him/her under this agreement.
The prizes of BMW bike or Harley Davidson bike or iPhone are solely offered by Ashwin Sheth Group as a part of this promotion. BMW, Harley Davidson and Apple, companies are not associated with this offer. Any reference to BMW, Harley Davidson and Apple are purely for illustration purpose and do not imply any endorsement or sponsorship of these companies. ASG takes the sole responsibility for fulfilling the prize won by the contestant during the offer period.
